Terms of Service for Sector Zero Capital

1. Acceptance of Terms

By accessing or using the services, software, and educational materials provided by Sector Zero Capital, you agree to be bound by these Terms of Service. Sector Zero Capital provides "Tactical Day Trading Systems". If you do not agree to all the terms and conditions of this agreement, you may not access our website, community platforms, or utilize our proprietary trading systems.

2. Strictly Educational and Software Provider

  • No Financial Advice: Sector Zero Capital is exclusively an educational and software development entity. We are not registered financial advisors, broker-dealers, or securities brokers.

  • Purpose: All content, including but not limited to code snippets, SOP's logic, market analysis, and automated strategy templates (C# / NinjaScript), is provided for educational and informational purposes only.

  • Execution Philosophy: Our operating philosophy is to "execute the system, or become liquidity". However, this is a conceptual framework for market mechanics, not a guarantee of profitability.

3. Risk Disclosure and Acknowledgment

Trading leveraged instruments, particularly futures contracts (such as MNQ, MES, and Gold), carries a high degree of risk and is not suitable for all investors.

  • Potential for Loss: You could lose some or all of your initial investment. You should only trade with risk capital—money that, if lost, will not adversely impact your lifestyle or financial security.

  • System Failure: Algorithmic and automated trading bots are subject to software bugs, connectivity issues, and platform execution errors. Sector Zero Capital is not liable for financial losses incurred due to the malfunction of custom scripts, trailing stop logic, or dynamic position sizing errors within your trading platform.

  • Proprietary Trading Firms: If you utilize our systems to trade evaluation accounts (e.g., passing funding evaluations), Sector Zero Capital makes no guarantees regarding your ability to secure or maintain funded status.

4. Intellectual Property

  • Ownership: All branding, logos, code, algorithms, and educational materials distributed by Sector Zero Capital remain the exclusive intellectual property of Sector Zero Capital.

  • Restrictions: You may not redistribute, resell, decompile, or claim ownership of our proprietary scripts, workspaces, or strategy logic. Our resources are for your individual, personal use as a trader. Unauthorized distribution will result in immediate termination of access and potential legal action.

5. User Conduct and Community Standards

Sector Zero Capital is built for dedicated traders. We maintain a zero-tolerance policy for:

  • Disruptive behavior, spam, or solicitation within our community channels.

  • Sharing proprietary information or unauthorized distribution of third-party intellectual property.

  • Making defamatory claims against the company or its members based on standard market losses.

6. Limitation of Liability

To the maximum extent permitted by law, Sector Zero Capital and its founders, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, systems, or educational content. You assume full responsibility for your trading executions and risk management.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts located in or nearest to Mount Maunganui, New Zealand, and you hereby consent to the personal jurisdiction of such courts.

8. Amendments

Sector Zero Capital reserves the right to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of the services following the posting of any changes constitutes acceptance of those changes.
